Thank you for your time on the telephone last week.

1. Situation
We are the owners and residents of Pierrepont House, Pierrepont Street, Bath BA1 1LA.
Pierrepont House is a single family five story dwelling and no longer includes a basement flat or upper story maisonette. The household includes two adults and three school age children.
Pierrepont House is situated on the corner of Pierrepont Street and Henry Street, and several of the living areas and bedrooms overlook the pavement area proposed for the outdoor seating area.
2. Observations on the Application
Whilst the application appears to fully detail the type and location of the proposed seating area, we are unable to determine proposals for its operation and management. We certainly have no objection to a responsibly managed external eating space; however, we would like to ensure that the following concerns are addressed,
a. Make it clear that the use of the outdoor area is for customers who are seated at tables, and that the sale of alcohol is ancillary to this use. The area should not be used as an extension to the hotel bar.
b. There should be no music played at a level that is audible with our property.
c. Use of the external area should cease no later than 10PM.
d. We note that the extent of the seating area far exceeds that which was present at the original hotel. We request that the council review whether so many tables are fitting for the area, as a minimum we request that the tables should be located as far as possible from Pierrepont Street.

e. Under no circumstances are bottles to be emptied into waste bins outside the premises.
We believe that the above formed part of the approved use of the space during occupancy of the original hotel; i.e. they are historic requirements that have been in place since we move to the area.
3 - Summary
Unfortunately, we do not have the relevant information to fully assess the application since there are no details of the proposed area operation and management.
Our primary concern is that the outdoor seating area if not responsibly managed may detract from the use of our home due to noise disturbance, and in particular the possibility of sleep disturbance affecting us and our children.

Bath Preservation Trust 1 Royal Crescent, City Centre, Bath, Bath And North East Somerset, BA1 2LR R 07/06/2018: Comment: The Trust is concerned regarding the extent of the scale of intrusion upon the setting of Grade I listed buildings by these tables and chairs, all of which clutter the streetscape. Whilst we have no objection to street furniture in this location as has been seen in previous years, we are concerned regarding the extent of the barriers which are restrictive and fence off large areas from the public realm. The bike racks appear to be placed awkwardly on the corner of the plot. We note neither the application form nor the description details the barriers or jumbrellas. The design and colour of the jumbrellas are inappropriate, particularly the fringe detail which is out of place and detracts from the appreciation of the listed buildings. In our view this area should not be barricaded and the colour of the jumbrellas should be muted and one tone only (perhaps just the pale green or Bath stone colour) with a simple plain design (with no advertising) to minimise the impression of clutter. Our other comment is that it would appear impossible for this amount of tables, benches and chairs to be stored away each night so this would appear to be a semi-permanent features within the streetscape, thus it must be of appropriate appearance to maintain and enhance the setting of the hotel and not detract from it. 07/06/2018
Andrew Averill Flat 7 Southbourne Mansions, South Parade, City Centre, Bath, Bath And North East Somerset, BA2 4AD R 13/05/2018: Unsure what an "associated drop off area" is but am working on the assumption that having spent 3 years turning our cul-de-sac into their building site without a care in the world, the hotel group is now in effect announcing their aim to use it as a coach park.
Don't worry about us, Bath Council: we only live here & pay our Council Tax to you. We wouldn't want to be a nuisance.
