Mrs Judith Mistral | 45 The Empire, Grand Parade, City Centre, Bath, Bath And North East Somerset, BA2 4DF | O | 16/02/2019: While I have numerous concerns about the proposed changes I am focussing on just two which seem to me to be paramount in regard to any permissions that may be considered by the Council. Firstly this application is being proposed as a Listed Buildings consent request, as was the previous application in 2018 which was subsequently withdrawn. If this was only about changing furniture and making some internal alterations this consent may be appropriate in order to comply with the preservation of a listed building. However this is actually a change of a use from a restaurant with ancillary alcohol consumption to the reverse, including the alteration of the large dining area to a substantially sized bar with poseur tables. It is clearly intended to be predominantly a drinking establishment run as more of a bar with food. I consider that the Council should recognise this fact and insist that the appropriate application be made in order to comply with existing contractual conditions. My second objection is the situation of the present Garfunkels, which is not only in a listed building but part of a residential retirement building. Running a business under a building which houses mainly elderly people needs due consideration and sensitivity in relation to particular issues like noise, smell and disturbance. While some of the apartments are separated from the restaurant by the conservatory type area, the outside terrace is right beneath other apartments and conditions regarding use of this terrace are currently in force which may change if the business changes fundamentally in character. As extended hours have also been proposed this would add to the potentially unreasonable disturbance in that area and of course the later night opening hours could affect all residents sleeping on that side of the building immediately above the existing Garfunkels. |
